HB 558 safeguards Social Security survivor benefits for foster youth—benefits earned through a parent’s work and intended to support a child after the loss of a parent. For many foster children, these benefits represent the last financial contribution a deceased parent can make to their child’s care, stability, and future.
In the past, states, including Idaho, utilized these funds to offset government foster care costs, effectively using a child’s survivor benefits to cover expenses for the youth in foster care the state would otherwise incur. In May 2025, Alex Adams issued the 'Director's Bulletin 2025-2' which updated the policy and practice to ensure that Survivor Benefits would not be used to offset state funds.
HB 558 is necessary because it puts the Director's Bulletin and policy change into state law to ensure this policy is safeguarded and effectively implemented regardless of future administrative or political influences. By codifying the policy, the Legislature ensures that foster youth will continue to receive their survivor benefits.
This bill promotes fairness, financial security, and dignity for children in foster care— while honoring the intent of Social Security and the work of parents who earned these benefits.
